Terms of Service

Plain-English version: These are our terms of service. If you have a real legal question, email legal\.com — we'd rather clarify in plain English than have you guess.

1. Acceptance of terms

By creating a ContactForge account or using any part of the service, you agree to these Terms. If you don't agree, don't use the service. We may update these Terms; material changes will be emailed to active customers at least 30 days before they take effect.

2. Your account

You're responsible for keeping your login credentials safe. Each user accessing the service requires their own account — account sharing across team members is not permitted on any plan. We may suspend accounts that violate these Terms, our acceptable-use policy, or applicable law.

3. Your content

You retain full ownership of all contact data, deals, messages, attachments, and other customer-relationship information you store in ContactForge. We need a limited license from you to host, display, transmit, back up, and process your content so the service can function. We don't claim ownership, we don't sell your content, and we don't use it to train AI models.

4. Acceptable use

You may not use ContactForge to send unsolicited bulk email, distribute malware, harvest contact data you don't have a lawful basis to process, infringe copyright, violate export controls, or otherwise break the law in the US or in the country your contacts are in. You are responsible for complying with applicable anti-spam and privacy law (CAN-SPAM, GDPR, CCPA, etc.) on any campaign you send.

Email-sending responsibility (BYO SMTP). Bulk campaign sends from your ContactForge account are dispatched through the SMTP provider you connect in Settings » Email Provider (Amazon SES, Postmark, SendGrid, Mailgun, or another SMTP relay you select). You alone are responsible for that provider's terms of service, acceptable-use policy, sender reputation, complaint rate, bounce rate, and per-email cost. We do not host, broker, or take ownership of your campaign sends — we relay the message to your provider on your behalf. ContactForge is not liable for deliverability outcomes, suspensions, or termination of your SMTP-provider account caused by your sending behaviour.

5. Subscription fees & billing

ContactForge is a SaaS subscription — we do not process buyer transactions or hold funds on your behalf. Every plan starts with a 14-day free trial, capped at 250 contacts during trial, no credit card required to start. After trial, the plan you select bills in advance on a monthly or annual cycle (Pro at /mo or /yr; Business at /mo or /yr). Stripe handles card processing under their standard rates and terms; we never see your full card number.

Overage charges (Business plan). If your usage exceeds the included caps on the Business plan in a given billing cycle, we apply automatic overage at the rates published on the pricing page: per 1,000 additional contacts above 100,000; per additional team seat above 25; per 1,000 additional campaign sends above 50,000 per month. Overage is itemised as a separate line on the invoice for that cycle. Pro does not accrue overage — once a cap is reached the action is paused until the next cycle or until the account is upgraded to Business.

6. Fair-use limits

If your monthly email send volume or API usage materially exceeds your plan's documented limits, we may queue or throttle excess to stay within ESP / third-party rate caps, and reach out to discuss an upgrade or custom arrangement. We will never silently fail your sends — you'll see throttle notices in the dashboard and on the affected campaign.

7. Refunds & cancellation

Subscription fees are billed in advance. Refunds for ContactForge subscription charges are issued as account credit and auto-applied to the next invoice (see Credit System on the Billing page). You may cancel any time; service continues through the end of the paid period and you can re-activate any time within 90 days without losing data.

8. Service availability

We target 99.9% monthly uptime and post real-time status at status.contactforge.com. Business plans include a 99.95% SLA with service credits when we miss it. The service is provided AS IS without warranty of merchantability or fitness for a particular purpose.

9. Limitation of liability

To the maximum extent permitted by law, our total liability for any claim arising from your use of ContactForge is limited to the amount you paid us in the 12 months prior to the claim. We're not liable for indirect, consequential, or incidental damages, including lost profits or lost data.

10. Termination

You may delete your account from Settings at any time. We may terminate accounts that violate these Terms with reasonable notice (or immediately for serious violations: fraud, malware distribution, repeated abuse of our send infrastructure). After termination you have a 90-day window to export your data.

11. Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws principles. Disputes are subject to binding arbitration in Wilmington, Delaware, except where prohibited by local consumer-protection law.

12. Changes

Material changes to these Terms will be emailed to active customers at least 30 days before they take effect. Continued use after the effective date is acceptance of the new Terms.
